The Application Process


  1. Filing the Petition: The U.S. citizen begins the process by filing Form I-130 (Petition for Alien Relative) with U.S. Citizenship and Immigration Services (USCIS). Supporting documents, including proof of marriage, must accompany the petition.

  2. National Visa Center (NVC) Processing: Once USCIS approves the petition, the case is transferred to the NVC, which reviews documents, collects fees, and schedules a consular interview.

  3. Consular Interview: The foreign spouse attends an interview at a U.S. embassy or consulate in their home country. They must provide additional evidence of the relationship and pass medical exams and background checks.

  4. Visa Issuance: If approved, the CR1 visa is issued, and the foreign spouse can enter the U.S. as a conditional permanent resident.
