Which is faster: K-1 or Marriage visa?
Navigating the path to permanent residency in the United States can feel like an intricate dance. But if you're in love and looking to make your life together official, you're already one step ahead. The fastest ways to get a green card often come down to two main options: the fiancé visa (K-1) and the spouse visa (CR-1 or IR-1).
The Fiancé Visa (K-1)
The K-1 visa is designed for U.S. citizens who want to bring their foreign fiancé to the States. First, the U.S. citizen files a Form I-129F, Petition for Alien Fiancé, which usually takes about 7-9 months for approval. Once approved, the foreign fiancé undergoes a visa interview at the U.S. embassy in their home country, adding another 2-3 months. Upon receiving the K-1 visa, the fiancé has six months to enter the U.S. The couple must marry within 90 days of arrival. After marriage, the foreign spouse applies for a green card through adjustment of status.
The Spouse Visa (CR-1 or IR-1
If you’re already married, the spouse visa might be the quicker option. The U.S. citizen or green card holder files a Form I-130, Petition for Alien Relative, which typically takes 7-10 months for approval. After approval, the case is transferred to the National Visa Center for processing, taking another 3-5 months. The foreign spouse attends an interview at the U.S. embassy, and if approved, receives the CR-1 (conditional resident) or IR-1 (immediate relative) visa. Upon entry into the U.S., the spouse automatically becomes a permanent resident.
